Blu Pebble Studio Photography Contract & Terms
Effective as of January 2025
This Photography Agreement (“Agreement”) is entered into between Blu Pebble Studio (“Photographer”) and Client (the individual booking the session), collectively referred to as “the Parties.”
By booking, paying a deposit, or confirming a session with Blu Pebble Studio, Client agrees to all terms stated herein.
1. Scope of Work
Photographer agrees to provide photographic services as outlined in the booking confirmation. This may include portrait, family, event, or themed sessions. The session duration, location, and package details will be confirmed in writing at the time of booking.
2. Payment, Retainer & Booking
- A non-refundable retainer (deposit) is required to secure your session date and time.
- Session dates are not held without a paid retainer.
- Remaining balance is due on or before the day of the session unless otherwise stated in writing.
- Failure to complete payment before or on the day of service may result in cancellation of your booking.
3. Cancellation, Rescheduling & Refund Policy
- Cancellations: Cancellations made within 48 hours of the session will result in full forfeiture of all fees and retainers.
- Rescheduling: You may reschedule once, subject to availability, if due to illness, weather, or emergency.
- No-Refund Policy: All payments are non-refundable, including in cases of dissatisfaction with artistic style, editing, or aesthetic preference. Photographer’s creative direction and post-processing style are final and non-negotiable.
4. Start Time, Punctuality & Grace Period
Sessions begin and end at the scheduled times agreed upon. Clients are expected to arrive on time and prepared.
- A 15-minute grace period is provided. After this time, Photographer reserves the right to cancel the session without refund or shorten the session to fit the remaining time slot.
- If a Client is late, the session end time does not extend beyond the originally booked duration.
Respect for time ensures quality service for all clients.
5. Editing, Retouching & Copyright Integrity
- Photographer retains exclusive control over editing, cropping, retouching, and color grading.
- Client agrees not to alter, filter, crop, or edit the images in any way, including through social media filters, third-party retouching, or print enhancements by outside vendors.
- Photographer provides fully edited, high-resolution images that represent the studio’s artistic standard.
- Raw or unedited files will not be released under any circumstances.
6. Copyright & Usage Rights
- All images remain the copyrighted property of Blu Pebble Studio.
- Photographer grants the Client personal usage rights for sharing, printing, and personal display.
- Images may not be sold, submitted for publication, or used commercially without written permission.
7. Social Media & Marketing Use
- Unless otherwise stated in writing before the session, Client grants Blu Pebble Studio permission to use images from the session for portfolio, social media, advertising, and marketing purposes.
- If Client prefers images not to be shared publicly, this must be communicated via email prior to the delivery of the final gallery.
- Client agrees not to post defamatory comments, negative reviews, or public content intended to harm Blu Pebble Studio’s reputation.
Mutual respect ensures a positive creative experience for all.
8. Harassment & Safety Clause
Blu Pebble Studio maintains a zero-tolerance policy for harassment or unsafe behavior.
- If Photographer feels unsafe, uncomfortable, or harassed during a session, Photographer may terminate the session immediately.
- In such cases, Photographer may issue a partial or full refund at their discretion.
Safety and comfort are always prioritized.
9. Artistic Style & Creative Control
Client acknowledges that they have reviewed Photographer’s portfolio and are familiar with the artistic style of Blu Pebble Studio.
- Photographer retains full creative discretion regarding poses, lighting, composition, and final editing.
- Creative differences are not grounds for a refund.
10. Image Delivery
Final edited images will be delivered via an online gallery within the time frame specified in your booking details. Delivery timelines may vary depending on workload or unforeseen circumstances, but the Photographer will communicate any changes promptly.
11. Liability
- Photographer is not responsible for acts of God, accidents, or technical malfunctions beyond control.
- Photographer is not liable for damage to physical or digital products once delivered.
- Liability is limited to the amount paid under this Agreement.
12. Agreement & Acknowledgment
By booking with Blu Pebble Studio, Client confirms they have read, understood, and agreed to all terms and conditions stated above. This contract is binding upon payment or booking confirmation.
